I was discriminated against because of my gender. Can I still file a complaint with my IC?

Yes absolutely. Pressure, force, intimidation, misuse of power, demanding favours outside of one’s work role, bullying, “othering” or exclusionary behaviour based on race, age, sex, religion, national origin, disability, pregnancy, or marital status is considered as illegal and falls within the ambit of harassment.

Are POSH policies only for women?

Under the POSH act, the victim can only be a woman. However, TrustIn recommends creating a gender neutral Safety Policy that looks at all forms of misconduct including sexual harassment under the POSH act.

What is POSH compliance?

POSH (Prevention of Sexual Harassment) compliance is a legal mandate in India under the POSH Act, 2013, requiring organizations to provide a safe working environment, constitute an Internal Committee (IC), and conduct awareness sessions.

Do I need an Internal Committee (IC)?

Yes, if your organization has 10 or more employees, you are legally required to constitute an Internal Committee to address complaints of sexual harassment.
